§ 6. Manufactureing districts.

    General requirements.

    1.

    No lot, parcel, or tract of land shall be used, and no building or structure shall be erected, altered, or remodeled for any of the following uses: abattoirs; manufacture of acid; arsenals; crematories, manufacture or treatment of creosote; fat rendering; manufacture of fertilizer; manufacture or storage of fireworks or explosives; dumping or reduction of garbage, dead animals, offal or refuse; processing refining of petroleum; ore reduction; manufacture of nitrocellulose; manufacture of synthetic polymers; manufacture or treatment of gutta percha; salt works; manufacture of sauerkraut; manufacture of soap; smelters; stock yards or slaughter of animals or fowl; manufacture or treatment of tallow, grease or lard; tanning, curing, or storage of rawhides or skins; distillation of tar; or batch asphaltic concrete and Portland cement concrete mixing plants.

    2.

    No activities involving the storage, utilization, or manufacture of materials or products which decompose by detonation shall be permitted, except such as are incident to manufacturing processes. Such materials shall include but shall not be confined to all primary explosives such as lead azide, lead styphnate, fulminates, and tetrocene; all high explosives such as TNT, RDX, HMX, PETN and picric acid; propellants and components thereof such as cellulose nitrate of nitrogen content of 12.5 percent or greater, black powder, boron hydrides, hydrazine, and its derivatives, pyrotechnics and fireworks such as magnesium powder, potassium chlorate, and potassium nitrate; blasting explosives such as dynamite and nitroglycerine, unstable organic compounds such as acetylides, tetrazoles, perchloric acid; perchlorates, chlorates, hydrogen peroxide in concentrations greater than 35 percent; and nuclear fuels, fissionable materials, and products and reactor elements such as Uranium 235 and Plutonium 239.

    3.

    Within 300 feet of a residential district boundary line all activities and operation shall be within completely enclosed buildings or may be out-of-doors if completely screened by a solid wall or uniformly painted solid fence at least eight feet in height, and open storage shall not be greater height than that of the enclosing fence, except that off-street parking for vehicles in operable condition and off-street loading and unloading space may be located in accordance with requirements set forth in section 7.

    4.

    No new building, structure, or land within 100 feet of any lot line of a lot located in a residential district shall be used in connection with the operations of any establishment, except in a M-2 district such distance may be reduced to 50 feet, and in an M-1 district 25 feet. Office street parking for vehicles in operable conditions and off street loading and unloading space may be located within this setback area in accordance with regulations hereinafter set forth in section 7.

    5.

    Any use established in a manufacturing district hereinafter shall be operated in such manner as to comply with applicable performance standards as hereinafter set forth governing noise, smoke, particulate matter, toxic or oxious matter, odors, fire and explosive hazards, or vibration, or glare of heat; and no use already established on the effective date of this ordinance shall be so altered or modified as to conflict with such applicable performance standards. Certification from a testing laboratory, approved by the town board, indicating compliance with the applicable performance standards shall accompany application for a building permit.

    B.

    Performance standards. Noise level, smoke emissions, open burning, and odor controls shall be as promulgated by the Environmental Protection Agency, State of Illinois, as form time to time amended and are adopted, as if fully and expressly set forth herein.

    C.

    M-1 wholesale and warehouse district.

    1.

    Permitted uses.

    a.

    The following uses are permitted provided they conform with applicable requirements set forth in general requirements and performance standards of this section, save for items 24, 25 and 26, which are uses that shall not be required to meet the general requirements and performance standards of this section and shall be permitted as a right.     (1)

    Animal hospitals.

    (2)

    Automobile service stations.

    (3)

    Beverage distributors—including bottling plants.

    (4)

    Building material sales and lumberyards.

    (5)

    Currency exchanges.

    (6)

    Frozen food lockers.

    (7)

    Fuel and ice sales—retail and wholesale.

    (8)

    Garages—public.

    (9)

    General administrative offices.

    (10)

    Greenhouses—without restrictions as to floor area, provided heating plant conforms with applicable performance standards set forth under general requirements of this section.

    (11)

    Heliports—provided they conforms with applicable federal, state and other local governmental regulations.

    (12)

    Laboratory or research establishments.

    (13)

    Machinery sales and service.

    (14)

    Monument sales.

    (15)

    Motor vehicle and equipment sales and service. (Ord. No. 53-05, 3-8-2005)

    (16)

    Open-sales lots.

    (17)

    Parking lots-commercial.

    (18)

    Public utility and public service uses including:

    (a)

    Electric substations and distribution states.

    (b)

    Railroad rights-of-way.

    (c)

    Telephone exchange, microwave relay towers, and telephone transmission equipment buildings.

    (d)

    Public transportation facilities, including shelters, terminals, parking areas, and service buildings.

    (e)

    Water filtration plants, pumping stations, reservoirs, and sewage treatment plants-public.

    (19)

    Signs.

    (20)

    Wholesale merchandising and storage warehousing.

    (21)

    Accessory building and uses.

    (22)

    Home occupations (office only), where the residence has been granted legal nonconforming structure status. (Ord. No. 85-01, 6/12/01)

    (24)

    Detached single-family residences on single lots (with the approval of the architectural review committee as set forth in section 11 of the Cicero Zoning Ordinance and in accord with the square footage restrictions as set forth in the R-1 District). (Ord. No. 122-06, § II, 11-14-2006)

    b.

    Manufacturing, fabricating, storing, cleaning, testing, assembling, repairing, or servicing establishments as determined by operations conforming with performance standards for M-1 districts and other regulations as set forth in section 7, A and B of this ordinance. (Ord. No. 85-01, 6-12-2001)

    2.

    Special uses. The following special uses may be allowed by special permit in accordance with provisions of section 8.

    a.

    Any use not listed above which is permitted in the C-1 or C-2 districts.

    b.

    Bus or truck garage, vehicle storage yard or terminal.

    c.

    Open air storage, contractors equipment yards, junk yards, and auto wrecking yards, provided that all outdoor storage areas are fully enclosed by solid fencing or walls not less than eight feet in height.

    d.

    Motor vehicle body repair and paint shop. (Ord. No. 28-95, 4-25-1995)

    e.

    Indoor and outdoor flea markets. (Ord. No. 12-99, 1-26-1999)

    f.

    g.

    h.

    3.

    Lot width. Not less than 50 feet.

    4.

    Floor area ratio.

    a.

    Not to exceed .90 for one-story building.

    b.

    Not to exceed 1.80 for a building containing two or more stories.

    5.

    Front yard. Not less than five feet.

    6.

    Side yards. No side yard is required unless it abuts a residential district in which case, the residential side yard requirements are required.

    7.

    Rear yard. A rear yard is not required except where a lot abuts upon a residential district in which case, there shall be a yard of ten feet.

    8.

    Off-street loading. Loading berths in accordance with provision set forth in section 7 of this ordinance.

    9.

    Off-street parking. Parking spaces in accordance with provisions set forth in section 7 of this ordinance.

    D.

    M-2 light manufacturing district.

    1.

    Permitted uses.

    a.

    Uses permitted in M-1 district.

    b.

    Manufacturing, assembling, disassembling, fabricating, repairing, storing, cleaning, servicing or testing establishments as determined by operations conforming with performance standards for M-2 district as set forth in section 6.B. of this ordinance.

    c.

    Railroad terminals, railroad switching and classification yards, repair shops and round houses.

    d.

    Police, fire and public safety buildings and community centers, accessory thereto. (Ord. No. 92-93, 12-14-1993)

    e.

    Public libraries and safety villages. (Ord. No. 125-96, 9-24-1996; Ord. No. 129-96, 10-15-1996)

    f.

    Shopping centers which may contain any of the permitted and special uses in the C-1 or C-2 district except residential uses.

    g.

    Methadone clinics or clinics for the treatment of drug or alcohol addiction provided such uses are not located within 500 feet of any zoning district zoned for residential use nor within 500 feet of any pre-existing school or place of worship. (Ord. No. 76-96, 7-9-1996)

    2.

    Special uses. The following special uses may be allowed by special permit in accordance with provisions of section 8.

    a.

    Motor vehicle body repair and paint shops.

    b.

    Motor vehicle sales lots. (Ord. No. 215-00, 10-24-2000)

    c.

    Construction offices located in either buildings or trailers. (Ord. No. 86-01, 6-12-2001; Ord. No. 203-01, 12-11-2001)

    d.

    Stadium, auditoriums, race tracks and arenas. (Ord. No. 11-03, 1-14-2003)

    e.

    Homeless shelters. (Ord. No. 78-99, § 2, 4-13-1999)

    3.

    Prohibited uses. The following uses are hereby expressly prohibited:

    a.

    Abattoirs.

    b.

    Acetylene gas manufacturing.

    c.

    Ammonia, chlorine or bleaching powder manufacture.

    d.

    Arsenal, except the storage of small arms ammunition.

    e.

    Asphalt manufacture or refining.

    f.

    Blast furnace.

    g.

    Candle manufacture.

    h.

    Coke ovens.

    i.

    Crematory.

    j.

    Creosote treatment or manufacture.

    k.

    Distillation of coal, wood or bones.

    l.

    Dyestuff manufacture.

    m.

    Fat rending.

    n.

    Fertilizer manufacture.

    o.

    Fireworks or explosives manufacture or storage except as provided in section 6A-2.

    p.

    Glue, size or gelatin manufacture.

    q.

    Gunpowder manufacture.

    r.

    Lamp black manufacture.

    s.

    Lime, cement or plaster of paris manufacture.

    t.

    Paint, oil, shellac, turpentine or varnish manufacture.

    u.

    Petroleum refining.

    v.

    Potash works.

    w.

    Phroxlin plastic, manufacture or the manufacture of articles therefrom.

    x.

    Reduction of garbage, dead animals, offal or refuse, except for municipal use.

    y.

    Rock or stone crusher.

    z.

    Rolling mill.

    aa.

    Rubber or gutta percha manufacture or treatment.

    bb.

    Slaughtering of animals.

    cc.

    Smelters or incinerators for industrial waste disposal.

    dd.

    Starch, glucose or dextrine manufacture.

    ee.

    Sugar refining.

    ff.

    Sulphurous, sulphuric, nitric, picric, or hydrocholoric acid manufacture.

    gg.

    Tallow, grease or lard manufacture.

    hh.

    Tar distillation or manufacture.

    ii.

    Tar roofing or waterproofing manufacture.

    jj.

    Tobacco manufacture or treatment.

    kk.

    Vinegar manufacture.

    ll.

    Wood pulling or scouring yeast plant.

    mm.

    Any other use that is, or is likely to become, an offensive nuisance or public danger.

    4.

    Floor area ratio. Not to exceed 2.0.

    5.

    Lot width. No requirement.

    6.

    Front yard. No requirement.

    7.

    Side yard. No requirement.

    8.

    Rear yard. No requirement.

    9.

    Building heights. No requirement.

    10.

    Off-street loading. Loading berths in accordance with provisions set forth in section 7 of this ordinance.

    11.

    Off-street parking. Parking spaces in accordance with provisions set forth in section 7 of this ordinance.

    E.

    M-3 general manufacturing district.

    1.

    Permitted uses.

    a.

    Uses as permitted in the M-2 district.

    b.

    Manufacturing, assembling, disassembling, fabricating, repairing, storing, cleaning, servicing, or testing establishments as determined by operations conforming with performance standards for M-3 district as set forth in section 7 of this ordinance.

    c.

    Motor freight terminals, provided motor freight terminals are not located West of Laramie Avenue.

    d.

    Accessory buildings and uses.

    2.

    Special uses. The following special uses may be allowed by special permit in accordance with provision of section 8.

    a.

    Motor vehicle body repair and paint shops.

    b.

    3.

    Prohibited uses. Same as M-2 district.

    4.

    Floor area ratio. Same as in the M-2 district.

    5.

    Lot width. Same as in M-2 district.

    6.

    Off-street loading. Loading berths in accordance with provisions set forth in section 7 of this ordinance.
