§ 3. Zoning districts.

    Establishment of districts. In order to carry out the purposes and provisions of this ordinance, the Town of Cicero is hereby divided into the following districts:

    1.

    Residential districts.

    R-1 Single and two-family residential where the buildings lawfully existed prior to October 1, 1990
    R-2 Multiple-family residential
    R-3 Residential—commercial
    R-4 Apartment—commercial

     

    2.

    Commercial districts.

    C-1 Neighborhood commercial
    C-2 Central commercial

     

    3.

    Manufacturing districts.

    M-1 Wholesale and warehouse
    M-2 Light manufacturing
    M-3 General manufacturing

     

    B.

    Map. The location and boundaries of the districts established by this ordinance are set forth on the zoning district map, dated which is incorporated herein and hereby made a part of this ordinance. The said map, together with everything shown thereon, and all amendments thereto, shall be as much a part of this ordinance as though fully set forth and described herein. The said map shall be filed with the office of the town clerk, and certified copies thereof in the office of the zoning administrator, and shall be open to the public reference at all times during which those offices are open. No later than March 31 of each year hereafter, a district map shall be published clearly showing the location and boundaries of the zoning district for the preceding year; except that, if [in] any calendar year, there are no changes, no map shall be published for such calendar year.

    C.

    Boundaries of districts. When uncertainty exists with respect to the boundaries of the various districts, as shown on the zoning district map, the following rules shall apply.

    1.

    District boundary lines are either the center lines of highways, streets, alleys or easements, tract or lot lines, or such lines extended unless otherwise indicated.

    2.

    Where the district boundaries are not otherwise indicated and where the property has been or hereafter will be subdivision into blocks and lots, the district boundaries shall be construed to be the boundaries of such districts.

    3.

    In subdivided property, the district boundary line son the zoning map shall be determined by use of the scale shown on the map.

    D.

    Annexed territory. Any additions to the incorporated area of the town shall be annexed under a pre-annexation agreement unless said requirement in waived by two-thirds vote of the board of trustees.

    E.

    Exemptions. The following public utility uses are permitted in any district: poles, towers, wires cables, conduits, vaults, laterals, pipes, mains, valves or any other similar distributing equipment, and telephone booths, provided that installation shall conform with rules and regulations of the applicable administrative authorities.

    F.

    Definitions.

    Dish antenna. Any antenna whether flat, concave, or parabolic, which is designed to receive satellite-delivered signals.

    Dwelling unit. Assuming any room or groups of rooms located in a dwelling and forming a single habitable unit with a series which are used or intended to be used for living, sleeping, cooking and eating.

    Family. Not more than two persons not related by blood, marriage or adoption living together as a single, cooking and housekeeping unit in a dwelling unit, but not including sororities, fraternities or other organization.

    Group home. A detached single-family dwelling occupied as a temporary residence by persons who have completed treatment for developmental disabilities who are in transition to permanent residences and will have cooperative living arrangements which does not constitute a family as defined in this ordinance. Group homes shall not include premises on which formalized counseling or other treatment would take place.

    Liquor store. Liquor store means a store licensed for the sale of packaged liquor for consumption off of the premises only.

    Home occupation. An occupation carried on in a dwelling by the resident thereof incidental to the principal use as a residence.

    Planned unit development. A tract of land which includes one or more lots which is developed as a unit under single ownership or control containing two or more principal buildings and otherwise meeting the zoning and building codes of the town.
