§ 94-378. Notice of violation.

  • (a)

    It shall be the duty of any police officer observing any vehicle wrongfully or illegally parked contrary to this article or other town ordinances, to take and record the license number of the vehicle. If the officer sees or talks with the owner or his agent in charge of the vehicle, the officer shall give to the owner or his agent in charge of the vehicle a notice or summons that he shall appear before a police magistrate designated thereon within a specified time, there to file his appearance, pay his fine or contest the charge.

    (b)

    If no owner or person in charge of the vehicle is seen or observed, the officer shall attach securely to the vehicle a numbered tag giving notice that, unless the owner appears before a police magistrate thereon mentioned at or before a designated time to answer the charge, the owner would be prosecuted for the offense.

    (c)

    If the owner fails to appear pursuant to the notice at the stated time and place, the officer giving the notice and observing the violation shall make or cause to be made a complaint and have a warrant issued for the arrest of the owner, provided that the name of the person appearing on the registration of the vehicle shall in all instances be prima facie owner of the vehicle.
